The course comprises of three parts:

  1. Principles of Civil Law/Rule of Law
  2. Albanian Commercial Law
  3. Albanian Labor Law

 

 Contents ( three parts)

  Part one  is designed as an introduction to law and to the Albanian legal system in general. This part is structured in two modules that all together will contribute in building the required knowledge in this field f law. The modules are: (a) Introduction to law and to the Albanian legal system (b) the basic principles of Albanian civil law.  During part one the student will examine the basic principles of the Albanian legal system and in particular those of the Albanian civil law. The intention of exploring these main features of the Albanian legal system is for the students to establish some basic knowledge before being introduced to more specific knowledge and information on Business and Labor law.

The second part focuses on specific legal information and knowledge on business law. This part is structured in two modules that all together will contribute in building the required knowledge in this field of law. The modules are: (a) the Albanian contract law; and (b) the Albanian commercial law. Students will examine the general principles of the Albanian law of contracts and the basic relationships associated to business and different legal forms among the business organizations.

The third part and final of the course is related to Albanian labor law. This part provides an introduction to Albanian labor law and more indepth information on the legal framework of labor. In Part Three the student will develop an understanding of the basic principles of the labor legislation and of  legal relationships amongst the employee and the employer.

 

Objectives

  • Develop an understanding of the concepts of “law” and “legal system”.
  • Draw/develop the institutional legal structure of the Albanian legal system.
  • Identify the role of the legal institutions within the frame of legislative, executive and judiciary power.
  • Identify the differences among the natural persons and the legal entities within the frame of civil relationships.
  • Develop an understanding of legal representation.
  • Develop an understanding of nature of contracts.
  • Identify the main steps in the process of the formation of contracts.
  • Develop an understanding of the general principles of Albanian commercial legislation.
  • Identify the differences among the four types of business organizations.
  • List the main documents that are necessary to set up a business organization from the legal point of view.
  • Develop an understanding of the general principles of Albanian labor legislation.
  • Identify the main factors of the legal relationship between employees and employers.
  • Develop an understanding of different forms of employment contracts.
